RICERCA PER MOTO
1. SUBJECT OF THE ONLINE CONTRACT
The "online" contract, accepted on the website "www.motomaniashop.com", is intended to be concluded between Motomania S.n.c. of Lombardi Alessandro & Ungarelli Dalmazio (later "Motomania"), with legal headquarters in Fidenza (PR), Via Pietro Cassani No. 820 dx, and a Customer, through a telematics sales system called e-commerce. Customer is defined as, in relation to contracts for the sale of goods or the provision of services, the Subject who formalizes a purchase on the site "www.motomaniashop.com". The term e-commerce refers to commercial transactions (purchase of products, economic transactions, exchange of commercial information, etc.), carried out by telematics via the internet on the domain "www.motomaniashop.com".
2. SALES PRICES, BUY AND PAYMENT METHODS, INVOICING
2.1 The sales prices on the "www.motomaniashop.com" website are intended as an offer to the public by Motomania, including I.V.A. and any other taxes. Exposed prices do NOT include shipping costs. The customer will be able to view the amount of transport costs before proceeding with the purchase. The purchase agreement is perfected only by the correct completion of the order form published on the site and by consent to purchase, manifested through online membership. The customer can choose the payment method before confirming the order, using one of the allowed modes.
2.2 Accepted payment methods are only:
- PAYPAL, via online transaction with Credit Cards (not registration to Paypal is required) and with all payment systems allowed by the holder of a Paypal account.
- Instant bank transfer
- Standard bank transfer
2.3 Any sales invoice must be REQUIRED and OPTED required when entering the purchase order. You will not be able to issue an invoice after the order is fulfilled, that is, after the goods have been delivered to the transporter.
It is INDISPENSABILE TO communicate, at the same time as the order is sent, the required data, FOR LEGGE, necessary for the issuance of the invoice, that is:
- COMPLETE COMPANY NAME
- FULL ADDRESS
- VAT MATCH
- TAX CODE
- INTERCHANGE CODE (SDI)
- CERTIFIED MAIL ADDRESS (PEC)
DON'T BE EMESSA FATTURA in case of missing, incorrect, incomplete data, or late announcement, that is, after the shipment of the goods.
3. TRANSPORT AND DELIVERY MODES AND COSTS
3.1 The shipment of purchased goods is entrusted to transport companies that carry out a national express courier service. NO RESPONSABILITY CAN be CHARGED TO MOTOMANIA IN CASE OF PERDITA, DAMAGE OR DELAY OF DELIVERY OF THE GOODS SHIPPED.
3.2 The electronic shopping system automatically calculates and adds to the order the costs of shipping costs. Shipping costs and any surcharges are detailed in the"Shipping Costs"section.
3.3 The sale of material goods via the Internet, being assimilated to mail-order sales, is exempt from the obligation of tax certification (receipt and receipt), as well as the issuance of the invoice, unless explicitly requested by the Customer. In this Motomania will issue regular invoice of purchased products, entering the document inside the shipped packages, or sending the document by e-mail to the order holder. The information provided by the Customer at the time of the order is the same for the issuance of the invoice. No change in invoice will be possible, after the issuance of the same.
3.4 Unless explicitly stated by our Customer Service, the delivery is understood to be flat on the street. When the courier delivers the goods, the customer is required to check:
- that the number of packages delivered corresponds to what is indicated in the shipping bulletin delivered by the courier;
- that the packaging is intact, un damaged, wet or otherwise altered, even in the closing materials (duct tape, holds).
- Supplementary notes to delivery: if the neck delivered is damaged or altered (e.g. with duct tape cut and/or replaced) we invite you to accept the package by applying the note "Acceptance with Reserve" on the courier document. If the courier's delivery document is "Accepted without a reserve of control", it will not be possible in any way to obtain the reimbursement provided by the insurance. We inform the Customer that the insured shipment provides, in the manner and terms defined by the contracts with the shipper, the refund of Euro 6.20 for each kilogram of goods weight.
3.5 Any issues relating to the physical integrity, correspondence or completeness of the products received must be reported within 7 days of delivery, as provided in this document.
3.6 In the case of non-collection within 5 working days of the material in stock at the courier's warehouses due to repeated impossibility of delivery to the delivery indicated by the Customer at the time of the order, the order will be automatically canceled.
4. TRANSACTION AND SHIPMENT RESPONSIBILITIES
Motomania disclaims any liability for disruptions attributable to force majeure, events that prevented the regular success of the contract, and is not liable for loss of goods or damage suffered during transport.
Motomania is also not responsible for the possible illegal and fraudulent use of credit cards, checks and other means of payment, since at no point in the purchase procedure is it able to recognize the credit card number of the buyer, who, operating on a secure connection, sends the data directly to the Banking Institute that manages the service. In the same way it is not able to check the correct and lawful provenance of the credit that is delivered by the customer at the collection of the goods.
5.1 All products sold by Motomania are covered by a conventional guarantee of 24 months from the date of purchase (unless otherwise stated on the product page) for compliance defects, under DL 24/02.
5.2 The ESSENTIAL conditions for receiving warranty assistance are as follows:
- The Customer will have to send a communication to the address email@example.com,describing, with appropriate clarity and detail, the alleged defects found. Accompanying this communication will be REQUIRED to attach images, of adequate quality, to support the complaint exposed.
- The customer will have to return the product to ours. headquarters (Motomania S.N.C. - Via Pietro Cassani, 820 dx - 43036 Fidenza - PR) with shipping in free port (transportation costs paid by the Sender). Any shipments to the assigned port, i.e. with transport costs paid by the Recipient, will be rejected and rejected to the sender.
Please note that in the absence of the required documentation (email communication and photographic documentation) and/or the non-receipt of the goods deemed defective, it will not be possible to activate the verification procedure of the warranty terms.
5.3 The manufacturer's conventional warranty is provided in the manner outlined in the documentation in the product packaging. Motomania, following receipt of the report by the Customer (according to the rules set out in step 5.2), will report to the Supplier/Producer the anomaly encountered and, if requested, will send the goods for the necessary checks.
5.4 The warranty applies to the product that has a compliance defect, provided that the product itself has been used correctly, in accordance with its intended use and as required in any technical documentation attached. This guarantee is reserved for the private consumer (a person who buys the goods for purposes not related to his professional activity, that is, makes the purchase without specifying a VAT number reference in the order form). In the event of a compliance defect, Motomania, without charge to the customer, restores the product's compliance by repair, or replacement, until the contract is terminated. If the right to replace the warranty product is not recognized, Motomania will report the reasons to the Customer, who will be charged for any verification costs, and/or control, and/or restoration required by the Supplier/Producer, as well as the related shipping costs.
5.5 If, for any reason, it is not possible to return to your customer a warranty product (restored or replaced), Motomania may proceed at your own discretion to the return of the amount paid, or to replace it with a product of equal or higher characteristics.
5.6 No damage can be caused to Motomania for any delays in making repairs, replacements, or product checks.
5.7 In cases where the application of the guarantees provides for the return of the product, the asset must be returned by the Customer in the original packaging, complete in all its parts (including packaging, any documentation and ancillary equipment, such as manuals, cables, etc.).
We recommend special attention to packaging, in order to avoid damage to the product and packaging during transport.
6. RIGHT OF WITHDRAWAL
6.1 If you are a private consumer (i.e. an individual who purchases the goods for purposes not related to their professional activity), you are entitled to withdraw from the purchase agreement, according to the following rules.
6.2 In order to exercise this right, you must send a notice to Motomania, no later than 5 working days from the date of receipt of the goods.
This communication must be sent to the firstname.lastname@example.org address, which will be followed by a new law of withdrawal, after checking the actual applicability of the right of withdrawal. authorization notice for return of goods.
The returned goods must be received indefinitely within 5 working days of the authorisation.
6.3 The right of withdrawal is subject to the following conditions:
The right applies to the product purchased in its entirety and it is NOT possible to withdraw only on part of the purchased product.
The right does NOT apply to:
- custom-made products
- products wrongly ordered by the customer
- products built on technical specifications required by the customer
- products that are clearly customized or which, by their nature, cannot be postponed or risk deteriorating or rapidly altering.
The returned products must be returned perfectly intact, in the original INTEGRA and complete packaging in all its parts, including original packaging, possible documentation, equipment, such as, for example, winery, cable ties, mounting brackets, wiring, etc.
Returned products where signs of use, assembly, tampering, and/or any other type of damage that may prevent them from being sold as a new product will not be detected. The products will remain available to the customer who can collect them at their own expense.
The shipping costs related to the return of the products, in the case of the application of the Right of Withdrawal, are borne by the Customer, as well as any costs for packaging, and/or any ancillary services.
The shipment, up to the certificate of receipt in our warehouse, is under the complete responsibility of the Customer.
Motomania is in no way responsible for damage or theft/loss of goods returned with uninsured shipments.
When the returned product is delivered, all checks on the status of the product will be carried out.
6.4 Motomania will reimburse the customer for the amount related to the goods returned (excluding the transport costs originally incurred for the shipment of the goods) within 15 days of receiving the returned goods, by reversing the amount charged on the credit card or by means of Bank Transfer. In the latter case, it will be the customer's care to communicate in a timely manner the data related to the current account (name of the account holder and IBAN coordinates) on which to credit the refund.
Shipping costs will NOT be refunded. If you have benefited from the free shipping, the amount relating to the shipping costs (approximately 9.90 euros) will be deducted from the refund amount.
6.5 Some products for sale have the note "Right of Withdrawal: NOT APPLICABLE" on the fact sheet. These products are supplied as a result of the customer's specific request. ON THESE PRODUCTS UNDER NO CIRCUMSTANCES AND FOR NO REASON WILL THE RIGHT OF WITHDRAWAL BE APPLICABLE.
To avoid damage to the original product and packaging, we recommend that you pack properly.
7. BUYER'S OBLIGATIONS
The consumer undertakes and obliges, once the "online" purchase procedure is completed, to provide for the printing and preservation of these general conditions, which, moreover, will have already been reviewed and accepted, as a mandatory step in the purchase, as well as the specifications of the product subject to the purchase. The purchaser is severely prohibited from entering false, and/or invented, and/or fictional data in the registration process necessary to activate the process for the execution of this contract and its further communications; Personal data and email must be exclusively your own real personal data and not third-party and/or fantasy data. It is expressly forbidden to make double registrations corresponding to a single person or enter third-party data. Motomania reserves the right to legally prosecute any violation and abuse, in the interests and for consumer protection.
By filling in the appropriate space, present on the website, the Customer authorizes Motomania to use their credit card, or other card issued in place of the same, and to charge to their bank account in favor of Motomania the total amount highlighted as the cost of the purchase made "online". The procedure takes place via a secure connection directly connected to the Banking Institute, owner and operator of the "online" payment service, which Motomania cannot access. If the consumer takes advantage of the right of withdrawal (see paragraph 8 of these general conditions) the amount to be refunded will be credited to the same credit card or in the way chosen by the customer.
9. CONTRACT RESOLUTION AND EXPRESS RESOLUTION
Motomania has the right to terminate the contract entered into by simply communicating it to the customer. In this case, you will only be entitled to the return of any amount already paid. The bonds taken by the Customer referred to art. 7 (Buyer's obligations), as well as the guarantee of the successful payment that the customer makes with the means referred to in art. 2 (sales prices and method of purchase) are essential, so that by express pact, the default, by the Customer, of only one of those obligations will result in the termination of the right of the contract, without the need for a judicial ruling, except for the right for Motomania to take legal action for compensation for the further damage.
10. PERSONAL DATA PROCESSING
The Customer, accepting these terms of sale, declares that he has read, understood and accepted in full, and without reservation any, the rules governing the processing of personal data, exposed in the specific section on the website ("Privacy").
11. APPLICABLE LAW
The sales agreement between the customer and Motomania is understood to be concluded in Italy and regulated by Italian law. For the resolution of any civil and criminal disputes arising from the conclusion of this sales contract, the jurisdiction is solely that of the Court of Parma.
